Terms of Product Sales

Terms and Conditions of Product Sales

Thank you for shopping with Sarah Payne Studios Ltd. We want your shopping experience to be enjoyable and straightforward, so these terms explain what you can expect when purchasing physical products from our website.

These terms apply to physical goods purchased through www.sarahpayne.co.uk, including fabrics, sewing supplies, haberdashery, books, patterns, quilt kits, craft equipment, mystery boxes and subscription hampers.

Digital downloads, online classes, workshops and retreats are covered by separate terms available on our Terms of Use page.

Nothing in these terms affects your statutory rights under UK consumer law.

1. About Us

Sarah Payne Studios Ltd, trading as Sarah Payne Quilter, is located at 12 Bourges View Maskew Avenue, Peterborough, England, PE1 2FG, is a company registered in England and Wales with registration number 12811588.

Website: www.sarahpayne.co.uk

For enquiries about orders, deliveries, returns or products, please contact us using the contact details provided on our website.

2. Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products.

You will receive an automated order confirmation by email. This confirms that we have received your order but does not necessarily mean that your order has been accepted.

A contract is formed when we confirm acceptance of your order, normally when we notify you that your goods have been dispatched.

We reserve the right to decline or cancel an order where there has been a genuine pricing error, a product is unavailable, payment cannot be authorised or we reasonably suspect fraudulent activity.

If we are unable to fulfil an order for which payment has already been taken, we will contact you and arrange an appropriate refund.

Please check your order details, including your delivery address, before completing your purchase.

3. Product Descriptions and Availability

We make every effort to describe and photograph our products accurately.

However, colours may appear slightly different depending on your screen settings, lighting and the nature of the materials.

Fabric designs and colour placement may vary depending on where the fabric has been cut from the bolt.

All products are subject to availability. Occasionally, stock discrepancies may occur, particularly during sales, special promotions and Facebook Live events.

If an item you have ordered is unavailable, we will contact you to discuss a suitable alternative or arrange a refund for the unavailable item.

We will never substitute a significantly different product without your agreement.

4. Prices and Payment

All prices are displayed in pounds sterling (GBP) and include VAT where applicable.

Delivery charges, where applicable, are calculated and displayed before checkout.

Payment must be made in full at the time of ordering unless an alternative payment arrangement has been expressly agreed.

We reserve the right to amend prices and promotional offers at any time. However, price changes will not affect orders that have already been accepted.

Discount codes and promotional offers cannot normally be combined unless specifically stated. Promotions apply only during their advertised period and are subject to any stated conditions.

5. Order Processing and Dispatch

We aim to prepare and dispatch orders as promptly as possible.

Sarah Payne Studios is a small independent business, and orders are packed around our teaching commitments, events and other business activities.

Dispatch times may therefore vary, particularly during busy periods, sales, product launches and seasonal promotions.

Any advertised dispatch times are estimates unless a specific delivery date has been expressly agreed.

Certain products, including mystery boxes, subscription hampers and special promotional collections, may have specific dispatch dates. These will be stated in the relevant product description or promotional information.

If there is an unexpected significant delay, we will endeavour to keep you informed.

Unless we have agreed otherwise, goods will be delivered without undue delay and within 30 days of the contract being formed.

6. Delivery

Delivery options and charges are displayed at checkout.

We use established postal and courier services to deliver orders. Where tracking is available, details may be provided once the parcel has been processed by the delivery provider.

Please ensure that your delivery address is complete and accurate.

If you discover an error in your address, contact us as quickly as possible. We will try to correct it before dispatch, but this may not always be possible.

Once a parcel has been dispatched, delivery times are controlled by the postal or courier service and may be affected by circumstances outside our control.

However, we remain responsible for your order until it has been delivered to you, or to a person you have nominated to receive it, in accordance with applicable consumer law.

If your parcel has not arrived within the expected timeframe, please contact us so that we can investigate.

If delivery cannot be completed because an incorrect or incomplete address was supplied, or because a parcel was not collected or accepted, additional delivery charges may apply where legally permitted.

7. Your Right to Cancel an Order

Under the Consumer Contracts Regulations 2013, customers purchasing most physical goods online have the right to cancel their order without giving a reason.

You normally have 14 days from the day after receiving your goods to notify us that you wish to cancel.

If your order contains multiple items delivered separately, the cancellation period normally runs from the day after you receive the final item.

To cancel, please contact us through the website, clearly stating your name, order number and intention to cancel. You may also use the model cancellation form provided below.

Once you have notified us of cancellation, you must return the goods within 14 days.

You are responsible for the direct cost of returning goods when cancelling because you have changed your mind.

We recommend using a tracked postal service and retaining proof of postage.

Goods may be inspected in the same way as they would be in a shop. If they have been handled beyond what is necessary to establish their nature, characteristics and functioning, we may make a lawful deduction for any reduction in value.

Certain goods, including products made to your individual specifications or clearly personalised for you, may be exempt from the statutory right to cancel.

These cancellation rights do not affect your rights if goods are faulty, damaged or incorrectly supplied.

8. Returns and Refunds

If you wish to return an item because you have changed your mind, please contact us before sending it back.

For a valid cancellation, we will refund the price paid for the returned goods and, where the entire order is cancelled, the original standard delivery charge where applicable.

If you selected a more expensive delivery service, we are only required to refund the equivalent cost of our standard delivery option.

Refunds will be made to your original payment method unless otherwise agreed.

We will issue the refund within 14 days of receiving the returned goods, or receiving satisfactory evidence that they have been sent back, whichever is earlier.

Where goods have not yet been dispatched, refunds will be processed within 14 days of cancellation.

Please do not return goods without providing sufficient information for us to identify your order.

9. Faulty, Damaged or Incorrect Items

We take care when selecting, preparing and packing orders, but occasionally mistakes or damage can occur.

If you receive an incorrect, faulty or damaged item, please contact us as soon as reasonably possible with your order number and details of the problem.

Photographs are helpful where available, particularly for damaged products, but are not a condition of exercising your statutory rights.

Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose.

Depending on the circumstances and the time since delivery, you may be entitled to a refund, repair or replacement.

Where goods are faulty or incorrectly supplied, we will cover reasonable return costs where a return is necessary.

Your statutory rights are not restricted by our normal cancellation or returns procedures.

10. Fabric, Cut Materials and Sewing Supplies

Fabric is generally sold in the quantities and measurements stated in the product description.

Where multiple units of fabric are ordered, we will endeavour to supply a continuous length wherever possible, but this cannot always be guaranteed.

Minor variations in fabric colour, print positioning and manufacturer specifications may occur.

Fabric cut specifically to a customer's individual measurements or specifications may be exempt from the statutory change-of-mind cancellation right. This exemption does not automatically apply to all fabric sold by the metre or to standard pre-cut lengths.

If a particular cut or continuous length is essential for your project, please contact us before ordering.

Any fabric or sewing supply that is faulty, incorrectly described or unsuitable under applicable consumer law remains covered by your statutory rights.

11. Quilt Kits and Bundles

Our quilt kits and project bundles are assembled with care and may include fabric, patterns, instructions and additional materials as specified in the product description.

Please read the product listing carefully to check exactly what is included.

Unless specifically stated, sewing machines, cutting tools, rulers, thread, wadding and other general sewing equipment are not included.

Occasionally, we may need to make minor substitutions because of supplier availability. Any substitute will be of comparable quality and suitability, and we will contact you before making a material change to the advertised kit.

12. Mystery Boxes and Surprise Products

From time to time, we offer mystery boxes and other surprise collections.

These products contain an assortment of items selected by us, and the precise contents are not disclosed before purchase.

By purchasing a mystery box, you understand that the selection is a surprise and individual products cannot be chosen.

Any advertised value represents the stated retail value of the included products at the time of the offer, unless otherwise explained.

The fact that the contents are a surprise does not remove your statutory cancellation rights or your rights in relation to faulty or incorrectly described goods.

Any special dispatch arrangements will be clearly stated when the mystery box is offered for sale.

13. Subscription Hampers

Our seasonal quilt hampers and other physical subscription products may be purchased through recurring payments or instalment arrangements.

The price, payment schedule, contents, delivery frequency and any minimum commitment will be explained in the relevant product description or subscription information before purchase.

Where a subscription involves payments towards a complete seasonal hamper, cancelling future payments does not automatically cancel any outstanding payment obligation for a hamper already purchased under the agreed terms.

Customers wishing to cancel or amend a subscription should contact us or use the subscription management facilities provided.

Statutory cancellation rights will apply where required by law, including any applicable rights relating to the delivery of physical goods.

If you join a subscription partway through a payment cycle, we will explain any additional payments required or alternative arrangements before completing the relevant hamper order.

14. Sales, Discounts and Special Offers

All sale products are subject to availability.

Promotional prices are valid only during the advertised promotional period.

We reserve the right to limit quantities where reasonably necessary, including during special promotions or where stock is limited.

Items purchased in a sale remain covered by the same statutory consumer rights as full-price products.

Sale or clearance status does not remove your legal rights to cancel an eligible online purchase or obtain a remedy for faulty goods.

15. Events Beyond Our Control

Occasionally, circumstances outside our reasonable control may affect our ability to fulfil an order. These may include postal disruption, severe weather, supplier difficulties or other unexpected events.

We will take reasonable steps to minimise disruption and keep affected customers informed.

Nothing in this section removes your statutory rights relating to delivery, cancellation or refunds.

16. Intellectual Property

Patterns, instructions, photographs, illustrations, designs and other original materials supplied with our products may be protected by copyright.

Purchasing a physical product does not automatically grant permission to reproduce, distribute, publish or commercially exploit any accompanying copyrighted materials.

Any specific permissions for using a pattern or design will be stated in the relevant product or pattern instructions.

Your statutory rights remain unaffected.

17. Liability and Your Consumer Rights

We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.

We do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or breach of your statutory consumer rights.

Nothing in these terms limits the remedies available to consumers under the Consumer Rights Act 2015 or other applicable legislation.

18. Changes to These Terms

We may update these terms from time to time to reflect changes in our business, products or legal requirements.

The terms applicable to your purchase will normally be those in effect when your order is placed.

19. Governing Law

These terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory consumer protections and rights relating to legal proceedings that apply in your place of residence.

20. Contact Us

If you have any questions about your order or these terms, please get in touch through the contact page on our website.

We are a small independent business and genuinely value every order. If something has gone wrong, please give us the opportunity to put it right.
